DIVORCEWORKS CHATBOT – TERMS OF USE (BETA)

These Terms apply between Helen Doukas trading as DivorceWorks (ABN 75 343 177 559) (“DivorceWorks”, “we”, “our” or “us”) and you, when you use the DivorceWorks Assistant (Beta) (“Assistant”). By continuing, you agree to these Terms.

The Assistant is an optional digital tool that provides general information and support for people navigating separation or divorce. It does not provide legal, financial or professional advice. Information entered into the Assistant is handled in accordance with the DivorceWorks Privacy Policy and the DivorceWorks Assistant Privacy Addendum.

The Assistant is in beta, meaning it is still being developed, tested and improved.

1. Not legal advice

Information generated by the Assistant:

  • is general in nature

  • is not tailored to your circumstances

  • is not legal, financial or professional advice

  • should not be relied on to make decisions

If you need legal advice, speak directly with a qualified lawyer. You may request a consultation with DivorceWorks at any time.

2. Your responsibilities

When using the Assistant, you agree to:

  • provide accurate information (to the extent you choose to share it)

  • avoid entering home addresses, account numbers or highly sensitive details

  • use the tool only for lawful purposes

  • not misuse, interfere with, damage, or attempt to reverse-engineer the Assistant

  • not use the Assistant to upload unlawful, harmful, defamatory, threatening or inappropriate content, or to train, build or improve a competing product or AI model

We may suspend or restrict access if we reasonably believe you have breached this clause.

You are responsible for how you use any information generated by the Assistant.

3. Availability and changes

The Assistant is currently free while in beta, although we reserve the right to introduce charges at any time.

Because the Assistant is in beta, it may be updated, changed, suspended or withdrawn at any time without notice. We do not guarantee uninterrupted access or error-free operation.

While we are committed to security, we cannot guarantee the security of any information transmitted over the internet. Transmission and exchange of information is at your own risk.

We may suspend or withdraw the Assistant, or your access to it, at any time.

4. Intellectual Property

All intellectual property rights in the Assistant, including the platform, content, workflows, prompts, designs, and underlying technology, are owned by DivorceWorks or our licensors.

You are granted a limited, revocable, non-exclusive licence to access and use the Assistant for your personal use. No other rights are granted.

Any feedback, suggestions or ideas you provide about the Assistant may be used by us for improvement and development purposes. You agree that we may use feedback without restriction and without payment to you.

5. Limitation of liability

To the maximum extent permitted by law:

  • DivorceWorks is not liable for any loss, damage or consequences arising from your use of or reliance on the Assistant; and

  • all information is provided on an “as-is” and “as available” basis.

These limitations do not apply to any liability which cannot be legally limited or excluded, including the non-excludable consumer guarantees of the Australian Consumer Law.

You acknowledge that these limitations allow us to make the Assistant available at no cost. Fees would have been substantially higher were we to assume greater liability.

6. Modifications

We may amend these Terms from time to time. The updated Terms take effect when published. If a change is material, meaning it affects your rights, obligations or access to the Assistant, we will give you at least 10 days’ notice. If you continue to use the Assistant after the amendment takes effect, you will be taken to have accepted the updated Terms. If you do not agree, you may stop using the Assistant at any time.

7. Governing Law

The laws of New South Wales, Australia apply to your use of the Assistant. Any disputes will be dealt with exclusively by the courts of New South Wales.
